I.A. No.13305 of 2022
Mr. Nath, learned advocate appears on behalf of petitioner and submits, his client is engaged in business of fishing. His client had two policies. On the contingency arisen, his client claimed on the policies. The insurance company did not pay. His client approached the Permanent Lok Adalat (PLA).
The PLA by award dated 8th February, 2019 directed payment on one policy. The insurance company paid on both and thereafter filed Civil Suit no.63 of 2022 in the Court of Civil Judge (Senior Division), Berhampur for recovery on the policy, regarding which the PLA did not direct payment. Hence, the award is under challenge.
Issue notice along with this order on opposite party no.2 by registered/speed post with AD. Petitioner will put in requisites.
There will be stay of proceeding in Civil Suit no.63 of 2022 pending in Court of Civil Judge (Senior Division), Berhampur till next date. The I.A. is disposed of.
List on 31st October, 2022.
