Judgment
M.S.Sahoo, J
The BLAPL has been filed under Section 439, Cr.P.C. seeking release on bail by the petitioner, who is in jail custody in connection with Jamankira P.S. Case No.63 of 2023 corresponding to G.R. Case No.323 of 2023 pending in the court of the learned S.D.J.M., Kuchinda, for alleged commission of offences under Sections 341/324/307/506 of the I.P.C.
Learned counsel for the petitioner files an affidavit in terms of the earlier order dated 25.08.2023 stating therein that the petitioner has no criminal antecedent till date apart from the solitary incident that has been reported out of which the present BLPAL arises.
Learned Standing Counsel for the State referring instructions received from the investigating agency submits that he has also received instructions that the petitioner does not have any other criminal antecedent, apart from the incident that has been reported in the present case.
Learned Standing Counsel for the State also refers to the case diary from the police that both the injured persons appeared before the police station on 06.07.2023 for the purpose of further investigation. The said persons appear to be in good health.
The affidavit filed on behalf of the petitioner dated 04.10.2023 shall be taken on record scanned copy as well as the case brief shall be updated.
Having heard learned counsel for the petitioner and the learned counsel for the State, this Court is inclined to grant bail to the petitioner subject to the conditions that would be imposed by the learned court in seisin of the matter.
The BLAPL is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
