Judgment
The petitioner undertakes to affirm and stamp the petition as per the Rules within a month of resumption of normal functioning of the court. The
petition is taken up through video conference on the basis of such undertaking.
The petitioner is the husband of the de facto complainant. We have perused the case diary and we do not find any prima facie material of offence
under Section 307 IPC. Therefore, prayer for anticipatory bail is allowed.
Accordingly, we direct that in the event of arrest, the petitioner be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only),
with one surety of like amount, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the
Code of Criminal Procedure, 1973. The petitioner shall meet the I.O. once in a fortnight. In case of the breach of any of the conditions, the
anticipatory bail shall automatically cancelled without any further reference to Court.
It is made clear that during the period of anticipatory bail the petitioner will not keep any connection with the de facto complainant for the purpose of
her security.
