Judgment
A photocopy of certified copy of the order dated 18.01.2018 passed in CGR Case No. 3756 of 2011 under Sections 120B/420/406 has been placed in
service by the petitioner in person in compliance of this Court’s order dated 27.03.2018. Effort has been made by the petitioner on his own to
serve a server copy of this Court’s order, which will be kept on record.
In this application the petitioner has simply prayed for appropriate order for direction on the learned Judicial Magistrate, 6th Court, Alipore, District : 24
Parganas (South) to dispose of the CGR Case No. 3756 of 2011 pending before him expeditiously within a specified time frame.
Considering the prayer being very innocuous, this Court is pleased to dispose of the criminal revisional application being CRR 3741 of 2017 with
direction to the learned Judicial Magistrate, 6th Court at Alipore, District : 24 Parganas (South) to frame the charge on the date fixed by the Court and
to hold the trial and dispose of the case within six months from the date of framing of charge.
It must be borne in mind by the learned Magistrate that the accused persons were successfully delaying the trial of the case for a considerable period
of time since 2011. If the accused persons are found defaulting in not appearing before the court, the learned Magistrate would be at liberty to take
coercive action under the law against them.
With the above directions, CRR 3741 of 2017 stands disposed of.
