Case taken up through video conferencing.
According to petitioner - Jaisika Verma, she was appointed as Clerk on daily wages on contract basis with the Panjab University, Chandigarh, on 28th April, 2010. Her term was extended from time to time.
She had proceeded on leave on 23rd May, 2016. Her term was upto 1st August, 2016. Further the petitioner contends that she had submitted an application for leave, which was duly recommended by the Competent Authority. She had given birth to a child on 24th January, 2017; since she was entitled to proceed on maternity leave, she applied for the same and thereafter, reported for rejoining the duty but was not allowed to do so. As such, she has filed the present writ petition.
The version of respondents is that since she had been appointed on daily wages on contract basis and her term was upto 1st August, 2016, she cannot claim any right for the re-appointment. The petitioner had submitted a representation to the respondents but her claim was not accepted.
During the course of arguments, learned counsel for the petitioner has submitted that keeping in view the fact that the petitioner is a married woman and has served the respondents sincerely for a substantial period and now she is out of job, she would be satisfied if the respondents are directed to consider her claim for reappointment sympathetically.
Learned counsel for the respondents states that in case petitioner submits a detailed representation along with supporting documents to the respondents, then they will consider the same and pass appropriate orders.
Under the circumstances, the present writ petition is disposed of directing that the petitioner would submit a detailed representation with the respondents along with supporting documents within a period of fifteen days from today. If such a representation is moved, the respondents would consider the same sympathetically and take a decision in the matter in accordance with law within a period of two months from the date of submission of such application.
