Judgment
Taken up through video conferencing.
Repeatedly called out. No one appears for the petitioner.
Perused the record. The District Commission vide its Order dated 23.01.2019 had allowed the complaint in part and ordered the insurance company (the respondent herein) to pay a sum of Rs. 6,80,820/- with interest at the rate of 8% per annum from the date of filing of the complaint and Rs.3000/- as compensation and Rs. 2,000/- as cost of litigation to the complainant (the petitioner herein). Appeal filed by the insurance company was partly allowed by the State Commission and the award made by the District Commission was modified to the extent that the insurance co. was ordered to pay Rs. 6,16,530/- with interest at the rate of Rs. 8% per annum from the date of filing complaint. This petition has been filed by the complainant in challenge to the said Order dated 17.05.2019 of the State Commission. It was filed on 23.08.2019. The defects have not been cured. On the previous occasion that this case was taken up i.e. on 20.09.2021 learned counsel for the complainant had requested for a period of two weeks to argue on admission. His request was acceded to and the case was listed for 05.10.2021 i.e. today. It was also directed that in the meanwhile the defects be cured.
The defects have still not been cured. Inspite of repeated calls, no one appears for the complainant. Sufficient opportunity, and more, has been provided to the complainant to argue its case on admission.
The revision petition no. 1938 of 2019 is dismissed in default for lack of prosecution.
The Registry is requested to send a copy each of this Order to all parties in the petition within three days. The stenographer is requested to upload this Order on the website of this Commission immediately.
