This assessee’s appeal for Assessment Year 2016-17 arises against the C IT(A)/NFAC, De lhi’ s DIN & order No. ITBA/NFAC/S/250/2025-26/1083823733(1) dated 18.12.2025, in proceedings u/s 147 r.w.s. 144 of the Income Tax Act, 1961 (in short “the Act”).

2.

Heard both the p arties at length. Case file perused.

3.

The assessee/appellant here in raises his solitary substantive ground directed against both the le arned lower authorities’ re spective assessme nt and lower appellate findings treating his cash deposits during demone tization amounting to Rs.15,00,000/- as unexplained; in assessment order dated 22.02.2024 as upheld in the lower appellate discussion.

4.

That being the case, learned counsel first of all files the assessee’s enrollment certificate issued by the Bar council of Punjab & Haryana at Chandigarh to the effect that he is a practicing advocate since 11.08.2011; and, therefore, possib ility of cash receipts in such a professio n carried out at various level etc. could not be ruled out in entirety. This is indeed coupled with the fact that not only the assessee has prima facie proved his opening cash in hand of Rs.3 ,65,000/-but also both the le arned low er authorities have nowhere considered his socio eco nomic st atus and past savings all alo ng. It is thus deemed appropriate in these peculiar backdrop that a lump sum addition of Rs.1,00,000/- only in the assessee’s hands would be just and proper with a rider that the same shall not be treated as a precedent. The assessee gets relief of Rs.14,00,000/- in other words. Necessary computation shall follow as per law .
