The instant writ petition has been filed for seeking quashing of impugned reply dated 15.11.2023 (Annexure P-9) vide which the claim of the petitioners regarding grant of benefit of step-up pay at par with their juniors has been rejected alleging the same to be arbitrary, discriminatory, illegal and unconstitutional.

Learned counsel appearing for the petitioners contends that respondent No.6-Smt.Anita who is junior to the petitioners is getting more pay than the petitioners and comparative charge has been given in para No.5 of the present writ petition. He submits that the petitioners sent a legal notice dated 08.09.2023 along with the pay fixations proformas annexed with the legal notice as A-1 and A-2, however, no action has been taken upon the same despite lapse of more than three months, hence, the petitioners have been compelled to approach this Court by filing the present petition. Learned counsel for the petitioners submits that, at this juncture, the petitioners would be satisfied in a case a direction is issued to the respondent No.2-the Director General, Department of Secondary Education, Haryana, to decide the representation dated 08.09.2023 (Annexure P-7) sent by the petitioners by passing a speaking and reasoned order in accordance with law and in a time bound manner.

Notice of motion to official respondents No.1 to 5 only at this stage.

Mr. Vivek Saini, Addl. A.G. Haryana, who is present in Court, accepts notice on behalf of the aforesaid respondents and he has no objection to the aforesaid prayer being granted.

Accordingly, with the consent of the parties and without commenting upon the merits of the case, the present writ petition is disposed of with a direction to the respondent No.2-the Director General, Department of Secondary Education, Haryana, to decide the representation dated 08.09.2023 (Annexure P-7) sent by the petitioners and to pass a speaking and reasoned order thereupon in accordance with law within a period of three months from the date of receipt of certified copy of this order after granting an opportunity of hearing to the petitioner.

Petition stands disposed of accordingly.
