Heard Mr. B. Deb, learned counsel for the petitioner/accused.
Also heard Mr. H. Kharmih, learned Addl. PP for the State respondent.
This application has been filed under Section 439 Cr.P.C with a prayer for grant of bail in favour of the petitioner/accused who was arrested in connection with Khliehriat P.S. Case No. 48 (06) 2023 under Section 21(c)/29 of the NDPS Act, 1985.
Learned counsel for the petitioner/accused submits that on investigation being completed, charge sheet has been filed.
Before proceeding with this matter, the learned counsel has however submitted that the case diary of Khliehriat P.S. Case No. 48 (06) 2023 may be directed to be produced before this Court to enable the Court to look into the facts and circumstances relating to the arrest of the accused/petitioner.
Mr. H. Kharmih, learned Addl. PP prays that he may be allowed to produce the case diary including the charge sheet on the next date fixed.
Prayer is allowed.
