Judgment
Ajay Tewari, J.—This is a petition for regular bail filed in case bearing FIR No. 236 dated 06.06.2010, under Sections 307/452 IPC registered at Police Station Narnaud, District Hisar.
On 23.02.2011 the following order was passed:
On the instructions from ASI Satbir Singh learned Deputy Advocate General, Haryana states that the factum of compromise is not in the knowledge of the police.
Learned Counsel for the Petitioner states that the Petitioner would produce the complainant before the Investigating Officer but he is in custody.
In the circumstances, I deem it appropriate to release the Petitioner so that the Petitioner alongwith the complainant and the witnesses will be appeared before the Investigating Officer to show that the matter has now been settled.
In the circumstances, I grant interim bail to the Petitioner to the satisfaction of C.J.M./Duty Magistrate, Hisar. Let the Petitioner, complainant and the witnesses be appeared before the Investigating Officer on 04.03.2011 at 10.00 A.M.
To come up on 29.03.2011.
Today Learned DAG, on instructions from ASI Rameshwar, has stated that the Petitioner and complainant did appear before the investigating officer as per the last order and they attested the relevant paper for a compromise which is hammered out between the parties.
In the circumstances order dated 23.02.2011 is made absolute subject to the conditions envisaged in Section 438(2) Cr.P.C., up to the filing of the challan, whereafter the Petitioner would be required to seek regular bail.
Petition stands disposed of.
