Judgment
Rekha Borana, J
The present bail application under Section 439 Cr.P.C. has been filed on behalf of the petitioner for the alleged offence punishable under Section 379, IPC in connection with FIR No.65/2022 registered at Police Station Jamsar, District Bikaner.
Heard counsel appearing for the petitioner and Public Prosecutor. Perused the material available on record.
Counsel appearing for the petitioner submits that the incident is alleged to be of 26.03.2022 whereas the FIR has been lodged on 23.04.2022 which is highly delayed and without any reasonable cause. Counsel further submits that the FIR specifically clarifies that although the incident of theft was in the knowledge of guards as well as authorities of the company, but the same was not reported for more than a period of one month. Moreover even he is not a named accused in the FIR.
Per contra, Public Prosecutor opposed the bail application. Having regard to the facts and circumstances of this case, particularly the fact that name of accused does not find mention in the FIR, therefore, without expressing any opinion on the merits/demerits of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted.
Consequently, the bail application is allowed. It is ordered that the accused-petitioner – Jagveer Singh S/o Sh. Bharat Singh arrested in connection with F.I.R. No.65/2022 registered at Police Station Jamsar, District Bikaner, shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs.50,000/- (Rupees Fifty Thousand) and two sureties of Rs.25,000/- (Rupees Twenty Five Thousand) each to the satisfaction of the learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
