Applicant Jagtar Singh @ Jassi is in judicial custody in FIR/Case Crime No. 661 of 2023, under Section 376 IPC, Police Station Rudrapur, District Udham Singh Nagar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, in the year 2022, the informant had hired a car driven by the applicant, but during the course of journey, the applicant spiked the drinks and when the informant lost her consciousness, she was raped by the applicant; the applicant made obscene videos and thereafter, blackmailed, established physical relations with the informant on multiple occasions and demanded money also.

Learned counsel for the applicant would submit that no obscene was recovered by the Investigating Officer; there is no obscene video as such; the applicant has no criminal history; it is a false case; there is no evidence of blackmailing; the FIR is much delayed; there is no specific date as to when the incident occurred; both the parties are major.

Learned State counsel would admit that during investigation no obscene video, as such was recovered.

Having considered the entirety of facts, this Court is of the view that the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
