Instant criminal appeal has been filed by the appellant under Section 454 Cr.P.C. against the judgment dated 21.09.2011 passed by learned Special Judge, NDPS Cases, Sri Ganganagar in Sessions Case No. 08/2007 by which the learned Judge confiscated the appellant's Hero Honda motorcycle bearing Engine No.RJ-04D60M02399 and Chassis No.04D63C02889.

Counsel for the appellant submits that no notice was served upon the appellant in compliance of Sections 60 to 63 of NDPS Act. It is submitted that the appellant is the registered owner of the motorcycle in question, therefore before confiscation a notice under Sections 60 to 63 of NDPS Act was required to be served upon the appellant and the proceedings in compliance of Sections 60 to 63 of NDPS Act have not been complied with. It is submitted that in such circumstances, the judgment of confiscation of motorcycle in question is per-se illegal and liable to be set aside. In support of his contention, the counsel for the appellant has relied upon the judgment of this Court in the case of Jaiprakash Vs. State of Rajasthan [2003 (3) R.Cr.D. 354 (Raj.)].

Per contra, learned Public Prosecutor has supported the impugned judgment and submitted that the trial court has discussed the reason of confiscation of motorcycle in question.

I have considered the arguments advanced before me and perused the impugned judgment.

In the case of Jaiprakash (Supra), this Court has observed as under :

"18. मेरे द्वारा योग्य जन अभियोजक को भी इस सम्बन्ध में सुना गया। अधीनस्थ न्यायालय द्वारा इस प्रकरण में जीप नम्बर आर जे 31 सी 1857 को राज्यसात करने का आदेश दिया है, मगर धारा 60 व 63 अधिनियम, 1985 के प्रावधानो को देखते हुए और धारा 63(2) के परन्तुक को देखते हुए अधीनस्थ न्यायालय द्वारा ऐसा आदेश दे दिया है जो कानूनन इसकी पुष्टि नहीं की जा सकती । चूंकि इस प्रकरण में अभियुक्तगण के विरूद्ध कोई आरोप भी प्रमाणित नहीं पाया गया है, एक अभियुक्त पूर्व में ही बरी किया जा चुका है और इन दोनों अभियुक्तगण के विरूद्ध भी एफ.एस.एल. रिपोर्ट को साक्ष्य में नहीं पढ़े जाने से चूंकि इन दोनों अभियुक्तगण के विरूद्ध आरोप प्रमाणित नहीं पाए गए है, इन परिस्थितियों को देखते हुए अधीनस्थ न्यायालय द्वारा जब्तषुदा जीप आर जे 31 सी 1857 को राज्यसात करने का आदेश बिना सुने पारित किया है, उसे भी कतई वैध नहीं ठहराया जा सकता। इन परिस्थितियों को देखते हुए अधीनस्थ न्यायालय द्वारा जीप को राज्यसात करने के जो आदेश दिए गए है, अपीलाण्ट गोपीराम द्वारा प्रस्तुत अपील संख्या 334/2001 एण्ड महिन्द्रा एवं महिन्द्रा फायनेसिंयल सर्विस लि. द्वारा प्रस्तुत फौजदारी विविध याचिका संख्या 95/2002, दोनों ही स्वीकार किए जाने योग्य है। मगर यह प्रकरण इस सम्बन्ध में बदली हुई परिस्थितियों को देखते हुए पुनः अधीनस्थ न्यायालय को इस आदेश के साथ प्रतिप्रेषित किया जाना आवष्यक है कि चूंकि अभियुक्तगण को बरी किया जा चुका है और बिना धारा 60 एवं 63 अधिनियम, 1985 के प्रावधानों की पालना किए अधीनस्थ न्यायालय ने वाहन जीप आर जे 31 सी 1857 की राज्यसात करने के आदेश दिए हैं, उस आदेश को अपास्त करते हुए जीप के सम्बन्ध में पुनः कानून अनुसार दोनों पक्षों को सुनकर जीप स्वामी व फायनेंस कम्पनी महिन्द्रा एण्ड महिन्द्रा फायनेसिंयल सर्विस लि. को सुनवाई का अवसर देकर व अभियुक्तगण की दोषसिद्धि प्रमाणित नहीं होने के तथ्य को ध्यान में रखते हुए जीप के निस्तारण का पुनः कानून अनुसार आदेश पारित करें।"

In the instant case, before confiscation of the Hero Honda motorcycle no notice was served upon the appellant as per Sections 60 to 63 of NDPS Act and also the proceedings in compliance of Sections 60 to 63 of NDPS Act have not been complied with, in such circumstances, the impugned judgment of confiscation of the motorcycle is suffered from illegality and infirmity.

Hence, the impugned judgment dated 21.09.2011 confiscating the motorcycle in question is set aside. The matter is remanded back to the trial court with the direction to proceed with the proceedings of confiscation of the motorcycle in question after making compliance with the provisions of Sections 60 to 63 of NDPs Act.

The criminal appeal is disposed of accordingly.

Record of the trial court be sent back immediately.
