Judgment
O R D E R
By Hon’ble Mr. Justice Om Prakash VII, Member (J) Heard Shri A.D. Singh, learned counsel for the applicants and Shri Chakrapani Vatsyayan, learned counsel for the respondents.
By way of the instant original application, the applicants has prayed for following main reliefs: -
“(i). Direct the respondent No. 2 to conduct the proper enquiry in the matter of promotion and selection of Goods Guard Grade Pay 2800/- (level-5) which has been unfairly conducted by the respondent No. 5 by committing the several irregularity and if it is found correct the selection may be cancelled and fair and fresh selection be made again in pursuant to the notification of selection dated 07.12.2021 within stipulated period of time as fixed by this Hon’ble Tribunal.
(ii). Direct the respondent No. 2 to decide the representation of the applicants dated 28.07.2022 (Annexure No. A-6) within stipulated period of time which was made for conducting the enquiry and doing the selection fairly regarding the promotion and selection of Goods Guard Grade Pay 2800/-(level 5).”
At this stage, learned counsel for the applicants made a statement at the Bar that the representation of the applicants dated 28.07.2022 (Annexure No. A-6) is pending before Respondent No. 2 and the applicants would be satisfied if the said respondent is directed to consider and decide their representation dated 28.07.2022 (Annexure No. A-6) in the time bound manner.
On the other hand, learned counsel for the respondents has raised objection to the aforesaid request of learned counsel for the applicant.
However, in view of the limited prayer made by the learned counsel for the applicants, this OA is disposed of with a direction to Respondent No. 2 / competent authority to decide the representation of the applicants dated 28.07.2022 (Annexure No. A-6), by way of a reasoned and speaking order within a period of two months from the date of receipt of certified copy of the order.
With the above direction, the OA is disposed off.
