Judgment
Sreenivas Harish Kumar, J
Heard petitioner’s counsel and the High Court Government Pleader.
The petitioner is working as an Assistant Executive Engineer at Karnataka Urban Water Supply and Drainage Board. The respondent-police laid a
trap and recovered a bribe amount of Rs.20,000/- from the petitioner. It is stated that the petitioner demanded the said bribe amount from the
complainant for passing his bill for Rs.47,72,743/-.
The petitioner has been in custody since 12.3.2020. By recovery of the bribe amount, it can be said that the major part of the investigation is over.
HCGP submits that what is remaining is to receive FSL report with regard to phenolphthalein test conducted at the time of trap. I do not think that the
petitioner will interfere with FSL authorities in giving the report. Therefore a case for granting bail is made out. Hence, the following order:-
(a) Petition is allowed.
(b) Petitioner shall be released on bail by obtaining from him a bond for Rs.50,000/-and two sureties for the likesum to the satisfaction of the trial
court.
(c) He shall appear before the trial court regularly.
(d) He shall not threaten the witnesses or tamper with prosecution evidence.
Communicate this order to the trial court and also to the jail authorities.
