R.S. Jha, J.—Heard Shri Piyush Tiwari, learned counsel for the petitioner on the question of admission. The petitioner has filed this petition alleging that the petitioner who has participated in the recruitment process for the post of Samvida Shala Shikshak Grade-II is not being awarded 5% additional marks in the written examination inspite of the fat that he is a green card holder. It is submitted that in such circumstances, the respondents/authorities be directed to add 5% marks in the written examination and thereafter consider the case of the petitioner for appointment on the said post.

Having heard the learned counsel for the petitioner and having perused the record specifically Annexure P/5, the Green Card, copy of which has been filed along with the petition, it is observed that in clause-2 of the said green card, it is provided that the petitioner would be entitled to 5% additional marks in the interview/viva. In the instant case, the petitioner is not claiming 5% additional marks in the interview/viva but in the marks obtained in written examination. Apparently, no provision for awarding 5% additional marks in the written examination is provided in the green card. In the circumstances, the petition being meritless is accordingly dismissed.
