Jagdish Ram vs HSIIDC and Others

M.M.S. Bedi, J.—The petitioner has filed this petition for a direction to the respondents to grant functional pay scales meant for technical

posts under the pay revision of 1991 and 1996, respectively, which is applicable to the employees of HSIIDC w.e.f. 1.5.1990 and 1.1.1996,

respectively. The petitioner has submitted his claim to the M.D. of the Corporation on 18.11.2011 (Annexure P-1). Counsel for the petitioner

submits that the request of the petitioner for revision of the pay scales has not been considered despite reminder (Annexure P-12). It is claimed

that the matter is covered by the judgment of this court in CWP 20592 of 2009 (Veer Pal & another vs. HSIIDC and others) decided on

17.8.2010.

This petition is disposed of with a direction to respondent No. 2 to consider the claim of the petitioner as raised in the legal notice (Annexure P-

II) and reminder (Annexure P-12) in the light of the above said judgment, by passing a speaking order within a period of four months after the

receipt of a certified copy of this order. In case the petitioner is held entitled to the relief, as has been granted to the other employees, similarly

circumstanced, the benefit will be released to the petitioner within next four months.
