For the reasons stated in the application, copy of judgment dated 7.5.2019, passed by erstwhile H.P. Administrative Tribunal in case titled as Kulbir Singh vs. State of H.P, i.e. OA No.1117 of 2015, is taken on record. The application stands disposed of.

CWP No.1661 of 2019

While placing reliance upon the aforesaid judgment rendered by Tribunal below in Kulbir Singh's case supra, learned counsel representing the petitioner contends that his case is squarely covered under the aforesaid judgment and as such, necessary direction may be issued to the respondents to grant him similar benefit.

Mr. Kunal Thakur, learned Deputy Advocate General having carefully perused the aforesaid judgment fairly admits that the case of the petitioner can be disposed of in the light of the directions contained in the aforesaid judgment rendered by the Tribunal below.

Consequently, in view of the above, the present petition is disposed of with the direction to the respondents/ competent authority to consider and decide the case of the petitioner in the light of the judgment rendered by Tribunal below in Kulbir Singh's case and in case petitioner is found to be similarly situate, he be also granted same benefits, within a period of four weeks. Pending applications, if any, also stands disposed of.
