Jagdeep Kaur Dhanju vs State of Punjab and Others

Kanwaljit Singh Ahluwalia, J.—Present petition has been filed by Jagdeep Kaur Dhanju, estranged wife of Balwinder Singh Dhanju. It is the

case of the petitioner that she was married on 8th March, 1998 with Balwinder Singh Dhanju, resident of village Fatehpur Rajputan, Tehsil and

District Patiala. At the behest of father-in-law of the petitioner, a Calandra (Annexure P-4) u/s 182 IPC was submitted by Station House Officer

of Police Station Sadar, Patiala against the petitioner.

Today, counsel for the State has filed an affidavit of Gurpreet Singh Gill, PPS, Senior Superintendent of Police, Patiala, wherein it has been

stated as under:

That the present affidavit is being filed in pursuant to the order dated 8.10.2010 passed by Hon''ble High Court in above said case.

That on receipt of copy of order dated 8.10.2010 it came to notice of answering deponent that the parties had taken divorce and are living

separately. The record further shows that both the parties have entered into a compromise and buried their hatchet for all times.

That keeping in view the fact that the matter has been compromised between the parties, therefore, no useful purpose is going to be served in

further proceedings of the present case.

That keeping in view the changed fact and circumstances of the case the Police is not willing to peruse the Calandra instituted u/s 182 IPC

against the petitioner. Necessary application for withdrawal of calandra will be filed in the learned trial Court in due course.

In view of the affidavit filed by the Senior Superintendent of Police, Patiala, the present petition is allowed and the impugned Calandra

(Annexure P-4) along with all subsequent proceedings, is hereby quashed.
