Judgment
Daya Chaudhary, J.—The prayer of the petitioner in the present petition is for issuing directions to the Judicial Magistrate Ist Class, Bilaspur, District Yamunanagar to expedite the trial of the complaint No. 1331 of 26.5.2010.
Vide order dated 9.2.2012, status report of said complaint was called for. In response to order dated 9.2.2012 a report has been received, wherein, it has been mentioned that the case is fixed for arguments on 26.4.2012.
Learned counsel for the State has brought to the notice of this Court that earlier also similar petition bearing Crl. Misc. No. M-39027 of 2011 for the grant of same relief was filed by the petitioner, which was dismissed as withdrawn vide order dated 22.12.2011 and this material fact has been concealed by the petitioner in the present petition.
Heard.
Keeping in view the status report and the fact that the petitioner has concealed a material fact from the Court by stating that no such or similar petition has been filed before this Court, whereas, earlier the petitioner has filed Crl. Misc. No. M-39027 of 2011, which was dismissed as withdrawn after arguments, no further direction is required to be issued. The present petition is dismissed with costs of Rs. 10,000/-to be deposited with Haryana State Legal Services Authority.
Copy of this order be sent to trial Court for compliance.
