The original petition is filed challenging Ext P10 order passed by the Debts Recovery Tribunal-2, Ernakulam, in S.A.No.109/2023, declining to stay further coercive proceedings initiated against the petitioner.
When the original petition came up for consideration on 20.04.2023, this Court on the submission made by the learned counsel appearing for the petitioner, stayed further coercive proceedings on condition that the petitioner pays off the entire outstanding amount in 10 equated monthly instalments starting from 02.05.2023.
The learned counsel appearing for the respondents submitted that pursuant to the above interim order, the petitioner has remitted two monthly instalments. Hence, the original petition can be closed making the interim order final.
Resultantly, the original petition is disposed of by making the interim order dated 20.04.2023 final. Needless to mention, if the petitioner defaults in payment of any of the instalments as ordered above, the respondents would be at liberty to revive the recovery proceedings from the stage it has been stopped.
The original petition is ordered accordingly.
