Judgment

By means of the present writ petition, petitioner has sought the indulgence of this Court for a direction to respondent to remove his name from Column 12 of the charge-sheet dated 13.07.2023, filed pursuant to the FIR No.101 of 2023 dated 27.02.2023, for the offences punishable under Sections 8/20/60 of the Narcotic Drugs and Psychotropic Substances Act, 1985, registered with P.S. Ramnangar, District Nainital.
It is the case of the petitioner that after investigation, charge-sheet has been submitted against the three persons named in the FIR, while the name of the petitioner was shown in Column 12 of the charge-sheet as a suspect.
Learned State Counsel submits that the petitioner is not appearing before the Investigating Officer, and therefore, the investigation against him is still pending. He further submits that the petitioner was also not available at the given address.
At this, learned counsel for the petitioner submits that due to the apprehension that the petitioner may be arrested, he is not appearing before the Investigating Officer. He further submits that the petitioner is ready to cooperate with the investigation and he would also appear before the Investigating Officer within 10 days from today, if some protection is granted to the petitioner.
Learned State Counsel has not objected the aforesaid request made by the learned counsel for the petitioner.
In view of the above, the present criminal writ petition is disposed of. However, it is provided that the petitioner shall appear before the Investigating Officer within 10 days from today i.e. on or before 25.07.2025 and no coercive measure shall be taken against the petitioner by the Investigating Officer, unless any credible evidence or material is found against him.
Pending application, if any, stands disposed of accordingly.
