A Deputy Ranger of Forest Department has come up before this Court seeking implementation of transfer order, dated 1st June, 2020 (Annexure P1) on the ground that despite being transferred, the respondentDepartment did not relieve him nor did issue any corrigendum to the transfer order and also on the ground that he will be retiring only after a short span of ten months and the action of the respondents in not relieving the petitioner is in violation of Clause 5.5 of Transfer Policy.
In sequel to the directions issued by this Court on 22nd June, 2020, Mr. Adarsh K. Sharma, learned Additional Advocate General, has placed on record the instructions and submitted that due to the fire season and for some other administrative exigencies, the petitioner could not have been relieved.
This Court is not oblivious of the fact that now, because of the onset of rainy season, the fire season is over. Even otherwise, the respondentDepartment did not issue any corrigendum to the transfer order (Annexure P1). Consequently, the respondents are directed to relieve the petitioner forthwith, in terms of the transfer order (Annexure P1).
The writ petition is disposed of with these directions, so also the pending miscellaneous applications, if any.
