This matter is taken up through Hybrid mode.
The Petitioner apprehending his arrest in Laxmisagar P.S. Case No.311 of 2021 corresponding to C.T. Case No.5419 of 2021 pending in the court of S.D.J.M., Bhubaneswar registered for alleged commission of offence punishable under Sections 354/324/427/34 IPC has filed this petition for his release on pre-arrest bail.
Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner stated to have entered the girls hostel and misbehaved the inmates of the hostel. Therefore, the allegation is serious in nature.
Considering the facts and submissions made, especially the nature of accusation, character of incriminating materials appearing against the petitioner and the gravity of the offence and the circumstances in which the offences stated to have been committed, this Court is of the view that the petitioner does not deserve to be released on pre-arrest bail.
Accordingly, the ABLAPL stands rejected.
