Yatindra Singh and Mahendra Dayal, JJ.—Shri Jagannath Prasad Tripathi (petitioner) was working as Extra Departmental Delivery Agent in Narainpur Indha Branch Post Office. He was given a chargesheet on 23.4.1991 levelling two charges against him.

The substance of the charges were that

(i) The petitioner had deposited Rs. 135/ and however subsequently he added words ''Dus Hazar'' and figure 10 making it Rs. 10,135/;

(ii) The second charge was that that he was to visit some villages. However, he did not visit them and had forged signatures of different persons on the visiting book.

The enquiry officer by his report dated 8.10.1991 did not find charges to be proved. However, the Reviewing Authority did not agree with the report of the enquiry officer issued a notice dated 24.12.1991 recording the reasons for disagreement.

The petitioner gave his reply and thereafter, vide order dated 30.4.1992, petitioner was removed from service.

The petitioner filed Original Application No. 361 of 1993. It was dismissed on 4.12.2000. Hence the present writ petition.

We have heard Counsel for the parties.

The first charge was the main charge against the petitioner. It was that he added figures 10 before the amount 135 as well as word ''Dus Hazar'' before the figure mentioned in words in the payinslip.

The Review Officer had found this charge to be proved. He has also found the other charge to be proved.

The finding recorded by the Reviewing Authority has been affirmed by the Tribunal. This is finding of fact. There is no illegality in the same.

The writ petition has no merit and is dismissed. Petition dismissed.
