Judgment

The applicant is a Doctor by profession employed with the State of Punjab. He has been arrested with respect to the offence punishable under Section 7 and Section 13(1)(d)(2) of the Prevention of Corruption Act, 1988. The complainant sells certain articles including biscuits. A sample of three biscuits was taken by the applicant and subsequently the applicant approached the complainant and even called in his office. Illegal gratification amounting to Rs. 22,000/ was demanded. It was settled at Rs. 20,000/. The complainant approached Vigilance Department Kapurthala. A raid was organised and it is alleged that the recovery was effected from the applicant.
The applicant presently in judicial custody and recovery has already been effected. Taking stock of the facts and circumstances, the applicant is admitted to bail, on his executing a personal bond to the sum of Rs. 20,000/ with a surety of like amount to the satisfaction of Special Judge, Kapurthala. This is subject to the condition
(a) The applicant will not directly or indirectly tamper with the evidence.
(b) Not visit to village Begowal without the permission of the Special Judge.
