Judgment
V. Narasingh, J
Mr. Behera, learned counsel submits that he has entered appearance on behalf of the Informant by filing vakalatanama. Registry is requested to tag the same in the file and reflect the name in the file and cause list.
Heard learned counsel for the Petitioner, learned counsel for the State and the learned counsel for the Informant.
The Petitioner is an accused in connection with C.T. Case No.448 of 2023, pending before the court of the learned J.M.F.C., Balasore, arising out of Basta P.S. Case No.190 of 2023 for alleged commission of offences under Sections 498-A/304-B/506/34 IPC.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Balasore, by order dated 13.07.2023 in the aforementioned case, the present BLAPL has been filed.
Admittedly in the case at hand investigation is continuing.
Taking into account the same, this Court is not inclined to entertain this bail application.
Liberty is given to the Petitioner to renew his prayer post charge sheet before the learned Court in seisin which shall be considered on its own merit.
Accordingly, the BLAPL stands disposed of.
Urgent certified copy of this order be granted as per rules.
