Judgment

The petitioners are seeking bail in Crime No.43/2020 of Aldur Police Station of Chikkamagalur District. The said case is registered against the
petitioners and the third accused for the offences punishable under Section 21 of Mines and Minerals Regulations and Development Act, 1957 and
Sections 379, 420, 188 read with Section 34 IPC on the basis of complaint of Smt.Sunitha K.R., PSI of Aldur Police Station.
It is alleged that the petitioners in violation of their permit extracted the sand from the creek situated near Aldur village stealthily and had stored 20
tractor loads of stolen sand in the land of the third accused. It is alleged that the said sand and the vehicles used in connection of the offence were
seized.
Petitioners are in judicial custody since 23.03.2020. The major offence alleged against the petitioners carries imprisonment up to 7 years. The
material part of the investigation is over and incriminating materials are already seized. Therefore, it is a fit case to grant bail to the petitioners.
Therefore, the petition is allowed.
The petitioners are granted bail in Crime No.43/2020 of Aldur Police Station, Chikkamagalur, subject to the following conditions:
(i) Petitioners shall execute personal bonds in a sum of Rs.50,000/-(Rupees Fifty Thousand only) each with two sureties in the like sum to the
satisfaction of the trial Court.
(ii) Petitioners shall appear before the IO/Court as and when required for the purpose of the investigation/trial.
(iii) Petitioners shall not tamper the prosecution witnesses in any manner.
(iv) Petitioners shall not indulge into any criminal activities.
Registry shall communicate this order to the jurisdictional Court.
