The prayer of the petitioner is to quash the recovery citation as contained in Annexure1 to the writ petition and to command the respondent not to adopt coercive methods against him for realisation of balance amount of unpaid Installments etc.

After some arguments Sri A.K. Banerjee, learned counsel for the petitioner and Mr. Unyal, learned counsel appearing for the respondent No.3 both of them agreed for disposal of this writ petition on the following terms and conditions:

(i) The entire unpaid amount along with interest, if chargeable and recovery cost shall be paid by the petitioner in three equal monthly Installments by him:

(ii) The first Installment to commence by 15th day from today.

(iii) The recovery proceedings shall remain stayed.

(iv) In case of any dafault in the payment of any Installment, the recovery proceedings shall continue to its logical ends.

(v) The petitioner will not be entitled to the cost of this writ petition.

Sri P.K. Bisaria, learned standing Counsel states that in view of the terms and conditions agreed upon between the petitioner and respondent No.3 he has got no objection to its acceptance.

In the ends of justice we accept the terms and conditions aforementioned and dispose of this writ petition accordingly.

The office is directed to hand over a copy of this order within a week to Sri P.K. Bisaria learned Standing Counsel for its intimation to and follow up action by the respondent No.2. Petition disposed of.
