Judgment
A counter affidavit has been filed by Mr. Mohanty, learned Additional Government Advocate today in Court. Copy of the same has been served on the learned counsel for the Petitioners.
Counter affidavit has been filed by the Opposite Party Nos.2 and 3 in which at paragraph-11 states hereunder:-
"11. That the Petitioners if agreeable, the district administration can go for direct purchase of his private land and in that event the Petitioners can be paid with lump sum amount at once which is more or less equivalent to compensation amount. The Petitioners will be benefited with 100% solatium on the value of the land and structure. It is apt to mention here that many private land owners are extending their cooperation with the district administration for direct purchase of their private land as the land acquisition procedure is normally time taking. In view of the same, the Petitioners should agree for direct purchase of their private land on bilateral negotiation with the district administration in which event they will not be prejudiced in any manner rather they will be benefited financially and otherwise."
Mr. Mohanty, learned Additional Government Advocate reiterates that the apprehension of the Petitioners that their land will taken away forcibly is entirely displaced and is in fact premature. He states that as of now no decision as such has been taken to acquire the land in question. If at all it is proposed to do so then the Petitioners will approached for direct purchase. He assures that there is no question of not following the due process of law.
In view of the above statements of Mr. Mohanty, no further directions are called for in the petition. The interim order is vacated. The petition is disposed of.
