These are bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Balliguda P.S. Case No. 104 of 2025 corresponding to CT Case No. 85 of 2025 pending in the file of learned Special Judge-cum-Addl. District & Sessions Judge, Balliguda for commission of offences punishable U/Ss. 20(b)(ii)(C)/29 of the NDPS Act, on the main allegation of financing illicit trade of Contraband Ganja.
Heard, Mr. Mahes Das, learned counsel for the petitioners in BLAPL Nos.3470 & 7436 of 2026; Mr. Suryakanta Dwibedi, learned counsel for the petitioner in BLAPL No.7129 of 2026 and Mr. C. Mohanty, learned Addl. PP in these matters and perused the record together with the copy of depositions of PWs.1 to 5 in BLAPL Nos.7129 of 2026 & 7436 of 2026.
Bail to the petitioners was in fact opposed to by the learned Addl. Public Prosecutor by relying upon the recovery of 91Kgs 310Grams of Contraband Ganja from the co-accused persons; but fact remains that neither any contraband article was recovered from the possession of the petitioners nor were they found apprehended from the spot with the contraband article. On a careful consideration of the materials placed on record, the only allegation appearing against the present petitioners is for financing for illicit trade of contraband article. Further, the witnesses examined so far in CT Case No.85(A) of 2025, wherein the petitioners Deepak Kumar Digal @ Sameer & D.N. Dinesh are the accused persons, none of the witnesses have testified against the petitioners Deepak Kumar Digal @ Sameer & D.N. Dinesh. In such view of the matter and taking into consideration the material placed on record, this Court considers that the petitioners have satisfied the conditions of Sec.37 of NDPS Act.
For the reasons stated hereinabove and taking into account pre-trial detention of the petitioner in custody and grant of bail to co-accused persons Simanchal Biswal in BLAPL No.2078 of 2026, this Court without expressing any view on merit admits each of the petitioner to bail.
Hence, these three bail applications of the petitioners namely Iswar Singh (BLAPL No.3470 of 2026); Deepak Kumar Digal (BLAPL No.7129 of 2026); and D.N. Dinesh (BLAPL No.7436 of 2026) stand allowed and each of the petitioners are allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
Accordingly, these BLAPLs stand disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
