Judgment
Issue notice. Mr. S.N. Das, learned Additional Standing Counsel accepts notice on behalf of the Opposite Party (State).
This is an application under Section 439 Cr.P.C. to release the Petitioner on bail in connection with Astaranga P.S. Case No.152 of 2020 corresponding to G.R. Case No.886 of 2020 pending in the Court of learned J.M.F.C. Nimapara.
This is the third time that the Petitioner has approached this Court for bail in connection with the aforementioned case.
It is submitted that charge sheet has already been filed. The allegation against the Petitioner is that along with his wife and sons he had detained the informant, assaulted, poured petrol on 28th December, 2020 and set fire. As a result, the informant sustained injuries.
One of the injuries was to the eyes of the informant was a burn injury and on the previous date, the Court had asked for a medical report to be submitted. Today, Mr. Das, learned Additional Standing Counsel for the State reads from the medical report which confirms that the burn injuries are completely healed and the eye sight is normal.
Considering that the Petitioner has been in custody since 29th December, 2020 and the charge sheet has already been filed and in view of the above circumstances, this Court directs that the Petitioner be enlarged on bail in connection with the aforementioned case subject to satisfaction of the trial Court.
The BLAPL is disposed of.
An urgent certified copy of this order be issued as per rules.
