Judgment

Heard both the sides.
The petitioner- Ismail Khan is in custody since 21.08.2022 in connection with Garhwa Mahila P.S. Case No. 19 of 2022 corresponding to G.R. No.1522 of 2022 (S.T. No.369 of 2022) for the offence registered under Sections 376, 504 of the I.P.C. pending in the Court of Additional Sessions Judge V, Garhwa.
It is submitted by the learned counsel on behalf of petitioner that from the F.I.R., it will be apparent that there is allegation of consensual physical relationship on false promise of marriage on the basis of which the offence under Section 376 of the I.P.C. will not be made out. Instant case has been lodged only to pressurize the petitioner to marry the informant.
Learned A.P.P. opposed the prayer for bail.
Under the circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
