Judgment
Subodh Abhyankar, J
They are heard. Perused the case diary / challan papers. This is the applicant's repeat (second) application under Section 439 of Criminal Procedure Code, 1973, as he / she is arrested in connection with Crime No.284/2021 registered at Police Station Leema Chouhan, District Rajgarh (MP) for offence punishable under Section 376 of Indian Penal Code, 1860. His earlier first bail application Miscellaneous Criminal Case No.3449/2022 was dismissed by this Court as withdrawn on 24.01.2022 with a liberty to renew his prayer after the Forensic Science Laboratory (FSL) report is received in the trial Court and is in favour of the applicant.
The applicant is in custody since 18.01.2021.
The allegation against the applicant is that of rape on the prosecutrix.
Looking to the FSL Report, no case for grant of bail is made out.
Accordingly, Miscellaneous Criminal Case No.16376/2022 being devoid of merits is hereby dismissed.
All the other pending interlocutory applications, if any, shall stand disposed of.
