P resent petition has been filed, seeking direction to the respondents to release salary of the petitioner for 104 days period of duly sanctioned medical leave by the respondent vide Office Order dated 31.10.2014, and also to release the annual increment due to the applicant on 1.6.2014 on the post of Clerk.
In reply filed on behalf of respondents, it has been stated that dues in question for 76 working days, detailed by petitioner in the petition, were under process with respondent No. 3 Regional Employment Officer, Shimla, and before filing of the reply, dues amounting to Rs. 80090/ had been paid to the petitioner on 16.12.2015 as per details enclosed with the reply as (Annexure RIV), after making statutory deductions such as double payment of salary for 26 days w.e.f. 5.11.2013 to 30.11.2013 and LIC, GPF & GIS etc.. It is further submitted in the reply that salary for 28 days for commuted leave and earned leave, as per Annexure A1, had already been paid by respondent No. 3.
In the light of contents of the reply, present petition is disposed of with liberty to the petitioner to approach respondent No. 3 for redressal of his grievances, if any, still survives and in such eventuality, respondent No. 3 shall decide the representation, so submitted, within three months by passing a speaking order.
