Arthur Strachey, C.J. and Knox, J.—Allowed the appeal so far as it related to the decree against Bhup Singh, dated the 5th of August 1886, but dismissed it so far as it related to the decree against Bhup Singh and Zabar Kunwar of the 15th of May 1885, observing that it was not necessary for the mortgagees of 1881 to have made Iman Ali Khan a party to their first suit, inasmuch as the earliest of his mortgages was not executed until after that suit was filed.
