Learned Additional Advocate General has placed on record communication dated 24.05.2024, which goes to indicate that the petitioner has been appointed as Shastri and he has joined as such on 30.09.2022.
Learned counsel for the petitioner states that as against the claim of the petitioner for his appointment in the year 2019, he was appointed 3 years later, i.e. in the year 2022. However, it needs to be noted that in case, the petitioner has unconditionally accepted his appointment, then now this issue may not be open for consideration.
Since claim of the petitioner relates to the year 2019, however, he has been given appointment in the year 2022, we deem it appropriate to dispose of this petition by directing the respondents to consider the case of the petitioner for his appointment against the vacancy of 2019 on notional basis for the purpose of seniority, pension and other benefits. However, monetary benefits as well as continuity of service from the year 2019 till the date of his joining, i.e. 30.09.2022 shall be admissible only on notional basis.
Pending application(s), if any, shall also stand disposed of. For compliance, list on 15.07.2024.
