Judgment
This Appeal has been filed against the Order dated 07th February, 2024 by which order the Adjudicating Authority has admitted Section 7 Application filed by the Financial Creditor, ICICI Bank Ltd.
An additional Affidavit has been filed bringing on record the entire payment made to the Financial Creditor. Learned Counsel for the Financial Creditor appears and submits that they have received the entire payment and there are no dues to be paid by the Corporate Debtor. Acknowledgment filed by the Bank has also been brought on record along with Additional Affidavit.
We take the additional affidavit on record, financial creditor having received the entire amount, no purpose shall be served in keeping this Appeal pending and continuing with the Corporate Insolvency Resolution Process. In result, the order dated 07th February, 2024 is set aside, the corporate debtor is freed from the CIRP. Counsel for the Appellant undertakes to make the actual payment of expenses incurred by the IRP on bills being submitted within two weeks, thereafter. Let expenses plus fee of Rs. 1.5 Lakh be paid to the IRP.
Appeal is disposed of.
