Judgment
Heard Mr. Arbind Kr. Sinha, learned counsel for the petitioners and Mr. Ashok Kumar, learned A.P.P. for the State as well as Mr. Sheo Kr. Singh,
learned counsel appearing for the opposite party no. 2.
The petitioners have prayed for grant of anticipatory bail, as they are apprehending their arrest in connection with Daltonganj Town P.S. Case No.
109 of 2019.
It has been alleged that at the time of marriage of the informant Rs. 5,00,000/- cash and household articles worth Rs. 1,20,000/- were given.
The informant appears to have earlier lodged a case being Palamau (Mahila) P.S. Case No. 24/2017 under Section 498-A of the Indian Penal Code
and 3/4 of the Dowry Prohibition Act. However, no mention has been made about any dowry given at the time of the marriage in the said First
Information Report. The petitioner no. 1 is the father-in-law of the informant while the petitioner no. 2 is the husband of the informant.
In such circumstances, therefore, I am inclined to extend the privilege of anticipatory bail to the petitioners.
Accordingly, the interim order dated 03.09.2019 is hereby confirmed.
This application stands allowed.
