At the outset, learned Counsel appearing for the Decree Holder seeks leave to withdraw the present enforcement petition with liberty to file the same afresh after depositing the requisite stamp duty and penalty, if any, in accordance with the Indian Stamp Act, 1899 and in light of the judgment passed by this Court in M/s URC Construction (P) Ltd. v. Airports Authority of India1.

Leave and liberty, as aforesaid, is granted.

Accordingly, the present petition is dismissed as withdrawn.

Pending application(s), if any, also stands dismissed.
