Judgment

On 24.07.2014, while issuing notice of motion the following order was passed by this Court:-
“CWP No.13285 of 2014
Learned Senior counsel for the petitioners refers to list of officials promoted in the rank of Head Constables under Rule 13.21 of Punjab Police Rules (Annexure P-7) to contend, inter alia, that while considering the case of the petitioners, the Officers Committee, as well as the respondent authorities fell in serious error of law, while not issuing any show cause notice to the juniors of the petitioners, including Bohar Singh at Sr.No.13, Gurmit Singh at Sr. No.16 and many others in the list Annexure P-7, before passing the impugned order withdrawing the promotion granted to the petitioners.
Notice of motion for 6.10.2014.
In the meantime, operation of the impugned order, shall remain stayed.”
Learned State counsel submits that petitioner No.1-Iqbal Singh has retired and petitioner No.2-Gurdeep Singh is holding rank of ASI (LR). The matter with respect to their promotion is pending before Home Department.
Mr. G.S. Bal. Sr. Advocate, who is present in Court, submits that as per his information, Home Department has cleared the file and matter is pending before Chief Secretary.
In the wake of interim orders, the petitioner No.1 continued to hold higher rank and has retired. The respondent has adorned petitioner No.2 with local rank of ASI. Dispute with respect to their entitlement to promotion is pending before Chief Secretary. In such circumstances, the petition stands disposed of with liberty to petitioner to move an application within three months, if cause survives.
