ORDER
IA/4639/2025: This IA has been filed by the RP, Mr. Sandip Kumar Bhatt, under Section 12A read with Regulation 30A of IBBI (CIRP Regulations) seeking withdrawal of the CP bearing No. 964 of 2020. RP present in person submits that, in this case the Corporate Debtor was admitted in the CIRP on 27.07.2022 and thereafter Committee of Creditors was constituted. He further submits that reconstitution of the COC took place on 16.09.2023, in which Karnataka Bank had 68% of voting and Intec Capital Limited had 32 percent of the voting. He further submits that in the 7th meeting of COC held on 20.09.2023 a resolution was passed to withdrawn the CP with 100 % voting. Further, the RP has enclosed the form FA dated 19.09.2025, which is forming part of this IA and this IA has been filed and affirmed by the RP himself.
Under the facts and circumstances all the parameters as mentioned under Section 12 A of the IBC are met. Accordingly, this IA is allowed and CP 964 of 2020 is dismissed as withdrawn. Form FA has been signed by the RP on 19.09.2025, he submits that entire CIRP cost as well as fee has been paid.
