Judgment
Swatanter Kumar, C.J.—In view of the order dated 19th March, 2009 passed by the Division Bench of this Court presided over by Hon''ble Shri Bilal Nazki and Hon''ble Shri A.R. Joshi, JJ., this Transfer application does not survive for consideration. The order dated 19th March, 2009 reads as under:
On 9th February, 2009 the petitioner appeared but refused to argue. To give fair chance, the case was adjourned to 10th February, 2009. On 10th February, 2009 wife of the petitioner appeared and sought adjournment and the case was adjourned. Today again nobody appears.
The petitioner is avoiding arguing this case and has also misbehaved with this Court. As such, this Court declines to hear this petition. Let the matter be placed before the learned Chief Justice for appropriate orders.
Registry to do the needful.
However, we consider it appropriate to issue a caution to the Petitioner/Applicant not to make any irresponsible statement in future. Merely because the Applicant/Petitioner appears in person does not mean that he has an advantage to make irresponsible statement. We do not consider it necessary to deal with even this aspect any further and do hope that the Applicant would be more careful in future and not make such irresponsible statement in his application.
The present Criminal Application does not survive and is dismissed as infructuous.
