Indu Aggarwal and Another vs State of Punjab and Others

R.P. Nagrath, J.—The petition is for quashing of F.I.R. No. 146 dated 11.07.2011 registered under Sections 420/120-B I.P.C. and the consequent proceedings on the basis of written compromise arrived at between the parties. The report has been received from the trial Court that the parties have entered into a compromise. Copy of statement of respondent No. 4-complainant has also been sent along with report.

Learned counsel for the State on instructions from S.I. Sumitter Kaur submits that as per the prosecution story stated in the challan on completion of investigation the only transaction involved is the one entered with respondent No. 4. Respondent No. 4-complainant has made statement before the trial Court that she does not want to pursue with the present case. It is also reported that the compromise is voluntary and without any pressure or coercion. In view of the statement of respondent No. 4-complainant and report of the trial Court and the principles laid down by the Full Bench judgment of this Hon''ble Court in Kulwinder Singh and Others Vs. State of Punjab and Another, , the instant petition is allowed and the F.I.R. and subsequent proceedings conducted on the basis thereof for offences under Sections 420/120-B IPC are quashed.
