Judgment
Hon''ble Prafulla C. Pant, J.—Heard. By means of this petition, moved u/s 482 of Code of Criminal Procedure, 1973, the petitioner has sought quashing of the proceedings of Criminal Case No. 776 of 2010 (old No. 196 of 2002) Indresh Bhatia vs. Ravindra Arora and others, relating to offences punishable u/s 406 and 420 I.P.C., pending in the court of Additional Chief Judicial Magistrate, Kotdwar, District Pauri Garhwal.
Learned counsel for the petitioner submitted that the petitioner (complainant) has entered into compromise with the respondent no.2 Ravindra Arora (accused), and he does not want to prosecute anyone of the accused.
Shri Indresh Bhatia identified by his counsel Shri D.C.S.Rawat, Advocate, is present in court who verified the fact that he has entered into compromise with the accused and does not want to prosecute them.
An Application No. 188 of 2012 has been filed supported by affidavit of Indresh Bhatia.
Both the offences 406 of I.PC., and 420 of I.P.C., are compoundable with the permission of the court.
In the above circumstances, the petition u/s 482 of Cr.P.C., deserves to be allowed. The petition u/s 482 of Cr.P.C., is allowed. The proceedings of Criminal Case No. 776 of 2010 (old No. 196 of 2002) Indresh Bhatia vs. Ravindra Arora and others, relating to offences punishable u/s 406 and 420 I.P.C., pending in the court of Additional Chief Judicial Magistrate, Kotdwar, District Pauri Garhwal. Are hereby quashed. (Compounding Application No. 188 of 2012 stands disposed of).
