1.

This is seventh bail application preferred by applicant under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with Crime No. 48/2023 registered at Police Station – Dharamjaigarh, District Raigarh (C.G.) for offence punishable under Sections 419, 420 and 376 of IPC.

2.

This court while deciding the fifth bail application of applicant in MCRC No. 7935/2025 order dated 08.10.2025 on merits, has taken into consideration that after arrest of applicant and filing of the charge-sheet, when applicant, on production warrant, was taken to Delhi in another crime registered against him, he fled away from the custody of police and hence that application was dismissed. Sixth bail application filed by applicant was dismissed as withdrawn vide order dated 04.08.2026 in MCRC No. 6777 of 2026.

3.

The first witness was examined on 29.06.2026 and the nineth witness was examined on 09.09.2026.

4.

Considering the fact that the trial is going on, prosecution witnesses are being examined and further considering that during production of applicant in another crime, he fled away from the custody of police, I do not find present to be a fit case to allow this application.

5.

Accordingly, this application is dismissed.

6.

However, considering the period of detention of applicant since 02.03.2023, trial court is directed to expedite the trial and to take all necessary steps and measures to cause presence of prosecution witnesses and conclude the trial at the earliest.
