Judgment

Heard Ms. S Deb Barman, learned counsel led by Mr. P Roy Barman, learned Sr. counsel appearing for the petitioners.
It is submitted that all the petitioners were appointed as LDC under the Labour Directorate on fixed pay basis and as per memorandum dated 16.10.2007 after completion of satisfactory service of five years they were entitled to get regular pay scale which has not been yet provided to them. The representations were submitted by them to the department and in turn the Labour Directorate has informed that the matter is now pending before the Council of Ministers. In such a situation the writ petition has been filed.
It is also submitted by learned counsel Ms. Deb Barman, that all the appointments were against regular posts.
Mr. K De, learned Addl. GA appears for all the respondents and waives service of formal notice upon the respondents. Learned Addl. GA prays for time to file counter affidavit.
