Judgment
Gopal Krishan Vyas, J.—Heard learned counsel for the petitioner. Learned counsel for the petitioner submits that in a departmental enquiry conducted against the petitioner for alleged misconduct, the petitioner''s services were terminated vide order dt. 11.01.2012 (Annex. 8) against which an appeal was preferred by the petitioner before the General Manager, Raj. State Road Transport Corporation Ltd. but the said appeal has been rejected by the appellate authority solely on the ground of delay.
After perusing the order impugned dt. 29.06.2012 (Annex. 10), this Court is not satisfied for denial of appellate authority to decide the appeal on merit, therefore, the order dt. 29.06.2012 passed by the appellate authority is hereby quashed and appellate authority is directed to decide the appeal of the petitioner against the order of termination dt. 11.01.2012 on merit after providing opportunity of hearing to the petitioner within a period of two months from the date of receipt of certified copy of this order. The writ petition is disposed of in above terms.
