R.S. Garg, J.
Diary of Crime No. 256/2000 of P.S. Mohan Nagar (Durg) registered for the offence punishable under sections 302/34, 120(B) and 201 I.P.C. as also u/s 7, 25 and 27 of the Arms Act, perused.
From the first information report it does not appear that the present applicant was armed with any weapon or had caused any cut injury to the deceased by means of any sharp cutting weapon.
The allegation of the prosecution are that taking an exception to the acts of the deceased and to teach some lesson to him Mohan caught hold of the deceased and all of a sudden accused Manohartook out a knife from his procket and casesed injury to the deceased.
Taking into consideration the nature of the allegation and the fact that the applicant did not caused any stab injury to the deceased, I consider present to be a fit case for admitting the applicant to bail.
The applicant is directed to be released on bail on his furnishing a personal bond in a sum of Rs. 10,000/- with one surety in the like amount to the satisfaction of the C.J.M. Durg for his appearance before the said Court or as and where so directed.
