Judgment
Heard Ms. Garima Diggiwal, IRP present in person. This application under Section 12A of the Insolvency and Bankruptcy Code, 2016 read with Regulations 30 A of the Corporate Insolvency Resolution Process has been filed on behalf of the IRP. It is stated in the application that pursuant to the decisions taken during the 2nd meeting of the Committee of Creditors of Corporate Debtor M/s Welfare Infrastructure Private Limited held virtually on 11.08.2023, resolved through 98.86% votes that IRP is authorized to take all necessary steps to process the withdrawal of the application under Section 12A of IBC. It is submitted by the Learned IRP that CoC constitute only Operational Creditors, there is no financial creditor in this matter. CoC by mandate of 98.86% voted for withdrawal of this present petition. Permission granted. CP No. (IB)- 28/9/JPR/2020 is dismissed as withdrawn.
